An appeal having been taken herein from an order of the Family Court, Niagara County, entered August 7, 2023, and petitioner-respondent having moved to strike the record on appeal, to dismiss the appeal, and for other relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is hereby ORDERED that the motion insofar as it seeks to strike the record on appeal is dismissed (see 22 NYCRR 1000.7 [b]), and
It is further ORDERED that the motion insofar as it seeks to dismiss the appeal is denied, with leave to renew in a responsive brief, and
It is further ORDERED that the motion insofar as it seeks an order imposing sanctions is denied.
