ORDER


Before the Court is the Report and Recommendation of United States Magistrate Judge Valerie K. Couch entered February 2, 2006. No objection to the Report and Recommendation has been filed nor has an extension of time in which to object been sought or granted. Therefore, the Report and Recommendation is ADOPTED in its entirety, Respondent's motion to dismiss [Doc. No. 21] the petition herein is GRANTED, the petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 [Doc. Nos. 1 and 6] is DISMISSED as moot and Petitioner's motion for a temporary restraining order [Doc. No. 4] is DENIED as moot.

It is so ordered.
