Appeal from Circuit Court for Dorchester County (INSLEY and CROCKETT, JJ.)

Action by Joseph E. Walter against Samuel Zalis to recover sums allegedly due for the value of certain machinery. The defendant filed a petition for an order staying proceedings in this second suit until the plaintiff paid the costs in his first suit, and from a dismissal of his petition the defendant appeals.

Appeal dismissed.

The cause was argued before BOND, C.J., SLOAN, DELAPLAINE, COLLINS, MARBURY, and GRASON, JJ.
