No. 05-06-00620-CV (Tex. App. Aug. 17, 2006)

Opinion

No. 05-06-00620-CV

Opinion issued August 17, 2006.

On Appeal from the 14th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 05-08973-A.

Dismissed.

Before Justices WHITTINGTON, BRIDGES, and RICHTER.

MEMORANDUM OPINION

The Court has before it appellees' July 19, 2006 motion to dismiss the appeal for want of prosecution. Appellees contend appellant Joyce Young failed to pay or make arrangements to pay the appropriate fee for the clerk's record. Appellant did not respond to the motion.

By letters dated May 2, 2006, we directed appellant to pay the $125 filing fee and provide verification that she had either made arrangements to pay for the record or was entitled to proceed without advance payment of costs. Both letters warned that the failure to comply could result in dismissal of the appeal. Nevertheless, to date, appellant has not paid the $125 filing fee or filed the requested documentation regarding the clerk's record.

Accordingly, we GRANT appellees' motion to dismiss. We DISMISS the appeal for want of prosecution. See Tex.R.App.P. 42.3(a).
