On Appeal from the County Court at Law No. 2 Galveston County, Texas
Trial Court Cause No. CV-0052700
CORRECTED ORDER
In this appeal, two volumes of the clerk's record were filed September 16, 2016. On October 21, 2016, the Galveston County Clerk filed a supplemental clerk's record containing 44 volumes. Clerk's records must conform to Appendix C of the Texas Rules of Appellate Procedure. Rule 1.1(e) of Appendix C provides that the trial court clerk must "start the page numbering on the front cover of the first volume of the clerk's record and continue to number all pages consecutively . . . and place each page number at the bottom of each page." Volume 1 of the supplemental clerk's record complies with this rule, but combines both volumes 1 and 2 into one volume. Volumes 3-44 of the supplemental clerk's record do not comply with Appendix C because they do not contain consecutively numbered pages. According, we issue the following order.
Volumes 1-44 of the supplemental clerk's record are ordered stricken. The Galveston County Clerk is directed to file a supplemental clerk's record that complies with Rule 1.1 in Appendix C of the Texas Rules of Appellate Procedure. The supplemental clerk's record is due within 30 days of the date of this order. Appellants' motion to extend time to file their brief is granted. Appellants' brief will be due 30 days after the date the compliant supplemental clerk's record is filed. No further extensions of time will be entertained absent exceptional circumstances.
