ORDER

Appellant, Paul Yonko, appealed from his January 23, 2023 conviction of the first degree felony offense of engaging in organized criminal activity. Appellant filed his brief on August 14, 2023. Accordingly, the State's brief was initially due on September 13, 2023. See Tex. R. App. P. 38.6(b). On September 14, 2023, the State filed a motion for extension of time to file a brief. The State's motion was granted, extending the deadline for filing its brief to October 24, 2023.

On October 24, 2023, the State filed its second motion for extension of time to file a brief. The State's motion was granted, extending the deadline for filing its brief to December 4, 2023. On December 12, 2023, the State filed its third motion for extension of time to file a brief. In its third motion, the State requests that the deadline for filing its brief be extended to January 3, 2024.

The State's motion is granted. The State's brief is due to be filed no later than January 3, 2024. No further extensions will be considered by the Court and failure to file a brief by January 3, 2024 may result in the Court setting the case "at-issue" and considering and deciding the case without a brief from the State. See Tex. R. App. P. 38.6(d).

It is so ORDERED.
