No. 04-17-00358-CR

From the 406th Judicial District Court, Webb County, Texas
Trial Court No. 2014CRN001641-D4
Honorable Oscar J. Hale, Jr., Judge Presiding
ORDER
Sitting: Karen Angelini, Justice Marialyn Barnard, Justice Rebeca C. Martinez, Justice
Appellant's brief was originally due January 16, 2018. On January 18, 2018, we granted appellant's motion for extension of time, which asked for a sixty-day extension, and ordered appellant's brief due on March 19, 2018. However, we explained that we would not grant any further extensions. Nevertheless, on March 14, 2018, appellant again asked for an extension, pleading that the reporter's record consisted of over thirty volumes. On March 23, 2018, we granted appellant's request and ordered appellant's brief to be filed on or before May 18, 2018. However, we explained that because this extension gave appellant 120 days from the original deadline, no further extensions would be granted. Nevertheless, appellant has again filed a motion for extension of time. This time appellant requests an extension of one week. Appellant's motion for extension of time is GRANTED.
We ORDER appellant's counsel to file appellant's brief on or before June 4, 2018. If appellant's brief is not filed by that date, we will abate this appeal to the trial court for an abandonment hearing. TEX. R. APP. P. 38.8(b)(2). Contempt proceedings may also be initiated against appellant's attorney. Id. 38.8(b)(4).
