Yellow Cab Co. v. Airocar, Inc.

District Court of Appeal of Florida, Fourth District
Sep 15, 1977
349 So. 2d 201 (Fla. Dist. Ct. App. 1977)

Opinion

No. 76-702.

July 22, 1977. Rehearing Denied September 15, 1977.

Interlocutory appeal from the Circuit Court for Broward County; Jose A. Gonzalez, Jr., Judge.

Richard B. Austin of Law Office of Richard B. Austin, Miami, for appellant.

R.T. Shankweiler of Patterson, Maloney Shankweiler, Fort Lauderdale, and John P. Bond of Bond Woitesek, Miami, for appellees.

Upon consideration of the record on appeal and briefs of the respective parties, we determine the trial court did not err in enjoining appellant from providing transportation service from the Fort Lauderdale-Hollywood International Airport, Broward County, Florida, until appellant had secured appropriate authority from the Florida Public Service Commission. Accordingly, the order appealed is affirmed.

Affirmed.

CROSS, DOWNEY and ALDERMAN, JJ., concur.
