Yanney v. American Equitable Corporation

Appellate Division of the Supreme Court of New York, Third Department
Mar 22, 1939
256 App. Div. 1028 (N.Y. App. Div. 1939)

Opinion

March 22, 1939.

Present — Hill, P.J., Rhodes, McNamee, Crapser and Heffernan, JJ.

This is an appeal from a judgment of foreclosure and sale. The proof clearly establishes that plaintiff is the owner of the mortgage in question and that defendant purchased the premises knowing that such mortgage was a lien thereon. Defendant cannot now attack the assignment of such mortgage to the plaintiff. Judgment unanimously affirmed, with costs.
