DECISION & ORDER ON MOTION

Motion by appellant for leave to reargue the respondent's prior motion to dismiss an appeal from an order of the Court of Claims dated January 19, 2012, on the ground that no appeal lies from an order denying reargument, which was determined by decision and order on motion of this Court dated September 12, 2012.

Upon the papers filed in support of the appellant's motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the appellant's motion is denied.
