Yablon v. Yablon

District Court of Appeal of Florida, Fourth District
Apr 21, 1982
412 So. 2d 964 (Fla. Dist. Ct. App. 1982)

Opinion

No. 81-2397.

April 21, 1982.

Petition for writ of certiorari to Circuit Court, Broward County; Joseph E. Price, Jr., Judge.

Mark L. Weinstein of Schwartz, Klein Steinhardt, P.A., North Miami Beach, for petitioner.

Mallory H. Horton of Horton, Perse Ginsberg, Miami, for respondent Daniel Mones, P.A.

No appearance for respondent Rochelle Yablon.

We grant the petition for writ of certiorari to the extent that we quash those portions of the trial court's order of November 25, 1981, to the extent that it imposes an attorney's charging lien on any property of the petitioner beyond his interest in the marital residence. We approve of the trial court's grant of a charging lien on the marital residence in accord with the parties' prior settlement agreement.

LETTS, C.J., and ANSTEAD and GLICKSTEIN, JJ., concur.
