PRADEEP KUMAR XPLORER, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan Chief Judge

By Order served October 18, 2023, this case was closed on the ground of duplication with the case at Docket No. 15790-23. The case remains closed. However, on October 20, 2023, petitioner electronically filed a document, designating the filing as a Motion for Continuance. Therein petitioner states, "I request one more weeks [sic] time to subpoena and upload any other reports."

To the extent petitioner's filing seeks a continuance, it is improper, as this case remains closed and is therefore not set for trial. See Rule 133, Tax Court Rules of Practice and Procedure. To the extent the filing constitutes a challenge to the Court's Order closing this case, petitioner offers no argument as to why this case should not have been closed on the ground that it is duplicative of the case at Docket No. 15790-23, which was itself closed on the ground of duplication with the case at Docket No. 9678-23.

It is accordingly

ORDERED that petitioner's Motion for Continuance is denied.
