No. 05-09-00274-CR (Tex. App. Nov. 18, 2009)

Opinion

No. 05-09-00274-CR

Opinion issued November 18, 2009. DO NOT PUBLISH. TEX. R. APP. P. 47.

On Appeal from the 194th Judicial District Court, Dallas County, Texas, Trial Court Cause No. F08-50773-M.

Before Chief Justice WRIGHT and Justices FITZGERALD and MURPHY.

MEMORANDUM OPINION

On February 16, 2009, after being convicted of unlawfully carrying a weapon in a tavern, Marcus Dwayne Wright filed a notice of appeal. Thereafter, on March 23, 2009, the State filed a motion to dismiss the case in the trial court, which was granted by the trial judge. Because there is no longer a judgment of conviction before us, we have no jurisdiction over this appeal. See Nikrasch v. State, 698 S.W.2d 443, 450 (Tex. App.-Dallas 1985, no pet.). Accordingly, we dismiss the appeal for want of jurisdiction.
