Dear Hon. Kaplan:

PLEASE TAKE NOTICE, that petitioner is requesting permission for an extention to continue to exhaust State remedies.

Petition was denied by the Appellate Court in relation to his C.P.L. § 440.10 motion. I am in the finishing process of filing an Writ of Error Coram Nobis pursuant to Federal Rule that an Error Coram Nobis must be filed within the state court prior to any Federal Court's determination of a previous filed Habeas Corpus petition.

Due to the fact that this facility has restrictive policies of the amount of time a prisoner can spend in the Law Library, I am forced to request for an extention to file a Writ of Error Coram Nobis with the state court.

If there is any discrepancy in regard to my request, please do not hesitate to notify me at your earliest convenience.
