ORDER

In an order filed October 5, 2000, this Court set an execution date of January 31, 2001, in the case of Philip Ray Workman. On January 26, 2001, the United States Court of Appeals for the Sixth Circuit issued a stay of execution pending the final disposition of a petition for writ of certiorari and a petition for an original writ of habeas corpus filed by Workman in the United States Supreme Court.

It appearing to the Court that on February 26, 2001, the United States Supreme Court denied the petitions for writ of certiorari and for writ of habeas corpus, it is hereby ORDERED, ADJUDGED and DECREED by a majority of this Court that the Warden of the Riverbend Maximum Security Institution, or his designee, shall execute the sentence of death as provided by law on the 30th day of March 2001 unless otherwise ordered by this Court or other appropriate authority. The State Attorney General shall provide a copy of any judicial or executive order staying the execution or granting a reprieve to the Office of the Clerk of the Appellate Courts in Nashville. The Clerk shall expeditiously furnish a copy of the order to the Warden of the Riverbend Maximum Security Institution.

Birch, J., filed a separate dissenting order.
