Supreme Court of Louisiana
Nov 22, 1974
303 So. 2d 179 (La. 1974)

Opinion

No. 55499.

November 22, 1974.

IN RE: ROBERTINE RHYMES COBB AND UNITED STATES FIDELITY GUARANTY COMPANY APPLYING FOR CERTIORARI OR WRIT OF REVIEW TO THE COURT OF APPEAL, SECOND CIRCUIT, PARISH OF RICHLAND.

Writ denied. No error of law.

SANDERS, C.J., and SUMMERS and MARCUS, JJ., are of the opinion that a writ should be granted.

BARHAM, J., concurs in the writ denial. The Court of Appeal cited the proper authority of law — Civil Code Article 2321 — Under Holland v. Buckley, 305 So.2d 113, Docket No. 54,317 this Court has redefined the responsibility under that article of the Code and that holding applies here and supports the result reached by the Court of Appeal.
