On order of the Court, the application for leave to appeal from the December 27, 2000 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND the case to the Court of Appeals for consideration as on leave granted. The court should permit the parties to file supplemental briefs if they so request. In addition to addressing the statutory issue presented, the court should address plaintiff's contention that the magistrate failed to decide plaintiff's request for attorney fees on medical services, treatment, care and medication other than that provided by Kelly Assisted Living Services, Inc.
