It is ordered and adjudged by this court that the judgment of the said Court of Appeals be, and the same is hereby, affirmed by the concurrence of six Judges, to-wit, Jones, Matthias, Day, Allen, Kinkade and Robinson, JJ. Inasmuch as four or more judges concurring in such judgment do not agree upon the grounds upon which such judgment should be placed, no authoritative opinion is filed.

Judgment affirmed.

JONES, MATTHIAS, DAY, ALLEN, KINKADE and ROBINSON, JJ., concur.
