Wilson v. State

District Court of Appeal of Florida, Fourth District
Jun 26, 1996
675 So. 2d 264 (Fla. Dist. Ct. App. 1996)

Opinion

No. 95-2588.

June 26, 1996.

Appeal from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Daniel Futch, Judge. L.T. Case No. 94-1150 CF10A.

Richard L. Jorandby, Public Defender and Allen J. DeWeese, Assistant Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Melynda L. Melear, Assistant Attorney General, West Palm Beach, for appellee.

Appellant appeals his convictions for armed kidnapping, armed robbery and grand theft. We affirm all issues except one which the state concedes, that dual convictions for robbery and theft, under these facts, are improper. We therefore reverse the conviction for theft.

GUNTHER, C.J., and KLEIN and STEVENSON, JJ., concur.
