JOINT STIPULATION AND ORDER FOR VOLUNTARY DISMISSAL OF ENTIRE ACTION F.R.C.P., Rule 41(a)(1)


Pursuant to Federal Rules of Civil Procedure, Rule 41(a)(1), plaintiff Diane B. Wilsey and defendant Indemnity Insurance Company of North America hereby agree and stipulate as follows:

1. Following extensive negotiations between and among representatives of the parties to this action and their attorneys, the parties to this action have reached a full and complete settlement of all claims and issues currently pending between and among them as set forth in the pleadings in this matter.

2. In accordance with the terms and conditions of the settlement, plaintiff desires to dismiss this action, with prejudice, as to all named defendants.

3. Accordingly, the parties agree and stipulate to the voluntary dismissal of this entire action, with prejudice as to all named defendants, each party to bear its own costs and attorney's fees.

ORDER

In accordance with Federal Rules of Civil Procedure, Rule 41(a)(1), the entire action filed by plaintiff Diane B. Wilsey is hereby dismissed.

PURSUANT TO STIPULATION OF ALL PARTIES APPEARING IN THIS ACTION,

IT IS SO ORDERED.
