ORDER DISMISSING COMPLAINT


This case was filed in September, 2001 and was originally assigned to a Magistrate Judge. The Magistrate Judge dismissed plaintiffs complaint with leave to amend and provided a thorough discussion of the pleading requirements plaintiff must meet. After several extensions, plaintiff amended his complaint. At that point, the Magistrate Judge issued a Referral for Reassignment, noting that no party had filed a consent to the Magistrate Judge's jurisdiction as required by 28 U.S.C. § 636(c); and recommending that the complaint be dismissed for failure to serve the defendant within 120 days of filing the complaint and because plaintiff failed to state any facts which could support a cause of action for employment discrimination under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq, for conspiracy under 42 U.S.C. § 1983 or § 1985, or age discrimination under 29 U.S.C. § 621. The case was subsequently reassigned to this Court.

This Court has reviewed the files and papers submitted by plaintiff, including his complaints and the papers filed along with them; and agrees that plaintiff has failed to state any claim for which federal relief may be granted. Accordingly, the complaint is hereby DISMISSED with prejudice for lack of subject matter jurisdiction.

IT IS SO ORDERED.
