CONFESSION OF ERROR


Based on the State's concession that the defendant's "(First) Motion for Post Conviction Relief" was timely filed, and therefore was improperly denied as untimely, the trial court's "Order Denying Petition To Vacate and/or Set Aside Judgment and Sentence" is hereby vacated and the cause is remanded for further proceedings consistent herewith.
