On Appeal from the County Criminal Court No. 9 Dallas County, Texas
Trial Court Cause No. MB17-63534-K
ORDER
Before the Court is appellant's July 27, 2020 motion for extension of time to file his brief. A review of this appeal shows that, following the trial court's February 4, 2020 judgment, appellant timely filed his notice of appeal. The record was due April 4, 2020. Although the clerk's record has been filed, no reporter's record has been filed. On June 23, 2020, we notified court reporter Trashuna Salaam that the record was overdue. We directed her to file, by July 23, 2020, (1) the reporter's record, (2) written verification that no hearings were recorded, or (3) written verification that appellant has not requested the reporter's record. To date, the reporter's record has not been filed and we have had no communication from Ms. Salaam. On June 23, 2020, appellant filed his docketing statement indicating he had requested the reporter's record from Janessa Thornell.
We ORDER the reporter's record filed by August 21, 2020. We caution Ms. Salaam and Ms. Thornell that the failure to file the reporter's record by that date will result in the Court taking whatever remedies it has to ensure the record is filed and that this appeal proceeds in a more timely manner.
Because the reporter's record has not been filed, appellant's brief is not yet due. We therefore DENY appellant's July 27, 2020 motion as premature.
We DIRECT the Clerk to send copies of this order to the Honorable Peggy Hoffman, Presiding Judge, County Criminal Court No. 9; Trashuna Salaam, official court reporter, County Criminal Court No. 9; Janessa Thornell, court reporter; and counsel for all parties.
