Petition for Allowance of Appeal No. 173 MAL 2007 from the Order of the Commonwealth Court at 43 CD 2007, dated January 11, 2007, quashing the appeal from the Order of the Department of Corrections, AY-8692, dated December 5, 2006.
ORDER
The Petition for Allowance of Appeal is Granted. The Order of the Commonwealth Court is reversed and the matter is remanded to that court with direction to address the petition for review on its merits. The Petition for Remand filed on behalf of Respondent is dismissed as moot.
