ORDER TO SHOW CAUSE

Pending before the Court is respondent's Motion to Dismiss for lack of Prosecution, filed October 7, 2022, docket entry 16.

By Order dated October 21, 2022, docket entry 17, the Court: (1) took respondent's Motion to Dismiss for Lack of Prosecution, filed October 7, 2022, docket entry 16, under advisement; (2) struck for trial from the October 31, 2022, Houston, Texas Trial Session, and continued this case; and (3) retained jurisdiction of this case until further notice.

After due consideration, and for cause, it is

ORDERED that petitioner shall show cause in writing, on or before February 23, 2023, why respondent's Motion to Dismiss for Lack of Prosecution, filed October 21, 2022, docket entry 17, should not be granted. It is further

ORDERED that the Clerk of the Court shall attach: (1) a copy of the 2017 Notice of Deficiency for this case; and (2) a copy of the Low-Income Tax Clinic information for Houston, Texas, Trial Sessions.

Petitioner is advised that failure to respond to this Order to Show Cause could result in the granting of respondent's Motion to Dismiss for Lack of Prosecution and a decision entered against petitioner for the amounts and year set forth in respondent's motion.
