Appellant's brief is overdue. Appellant's brief was originally due September 24, 2023. On September 27, 2023, this Court notified appellant's counsel, Kristin R. Brown, that appellant's brief was overdue. We directed Ms. Brown to file appellant's brief and a motion for extension of time to file the brief by October 9, 2023. As of the date of this order, appellant's brief has not been filed, and Ms. Brown has not filed a motion for extension of time to file the brief.
We ORDER Ms. Brown to file appellant's brief and a motion for extension of time to file the brief on or before NOVEMBER 20, 2023. See TEX. R. APP. P. 38.8(b)(2). If appellant's brief and the motion for extension of time to file the brief are not filed by that date, this appeal may be abated for the trial court to make findings in accordance with Rule of Appellate Procedure 38.8. See TEX. R. APP. P. 38.8(b)(2).
We DIRECT the Clerk to send copies of this order to the Honorable Tomasz Nowak, 366th Judicial District Court; and counsel for all parties.
