Petitioner is deemed insolvent and may proceed in forma pauperis for purposes of this cause.

Following review of the emergency petition for writ of prohibition, it is ordered that said petition is hereby dismissed pursuant to Logan v. State, 846 So. 2d 472 (Fla. 2003). Petitioner's motion for leave to refile a writ of prohibition is denied as moot.
