ORDER OF DISMISSAL

This case is calendared for trial on the Court's February 22, 2022, Philadelphia, Pennsylvania trial session. On December 23, 2021, petitioner filed a motion to dismiss pursuant to Wagner v. Commissioner, 118 T.C. 330 (2002). The motion states that respondent is not opposed to the granting of the motion.

Upon due consideration and for cause, it is

ORDERED that this case is stricken for trial from the Court's February 22, 2022, Philadelphia, Pennsylvania trial session. It is further

ORDERED that petitioner's motion to dismiss filed on December 23, 2021, is granted and this case is dismissed.
