This case was calendared for trial at the session of the Court scheduled to commence on April 3, 2023, for San Francisco, California. On March 20, 2023, respondent filed a Motion for Continuance, and stated that he was awaiting receipt of substantiation documents related to petitioner Timothy J. Westin's taxable year 2017, which is the subject of the instant proceeding. By order of the Court, dated March 21, 2023, this Division of the Court granted respondent's Motion for Continuance, struck the case from the aforementioned trial session, retained jurisdiction of the proceeding, and ordered the parties to file a status report on or before May 22, 2023.

Respondent filed a status report on May 22, 2023, and informed the Court that he received Mr. Westin's documents on May 4, 2023, and is currently in the process of reviewing these documents for the purpose of settlement. Therein, respondent requested an additional 60 days to complete the review of the records and submit either a stipulated decision or another status report.

Upon due consideration, it is

ORDERED that, on or before July 24, 2023, the parties shall file a proposed stipulated decision or status report (jointly if possible, otherwise independently) to inform the Court of the then-present status of this case.
