In an action to recover damages for breach of contract, the plaintiffs appeal from an order of the Supreme Court, Westchester County (Smith, J.), dated July 13, 2011, which granted the defendants' motion for summary judgment dismissing the complaint and denied their cross motion for summary judgment on the complaint.
ORDERED that the order is affirmed, with costs.
For the reasons stated in the case entitled Westchester County Correction Officers Benevolent Assoc., Inc. v County of Westchester, 99 A.D.3d 998, –––N.Y.S.2d –––– (Appellate Division Docket No. 2011–01209, decided herewith), the Supreme Court properly granted the defendants' motion for summary judgment dismissing the complaint and denied the plaintiffs' cross motion for summary judgment on the complaint.
