WEST CONTRACT SERVICES v. ROHR

District Court of Appeal of Florida, First District
Jan 19, 1996
665 So. 2d 317 (Fla. Dist. Ct. App. 1996)

Opinion

Nos. 94-3753, 94-3792.

December 18, 1995. Rehearing Denied January 19, 1996.

An appeal from Order of the Judge of Compensation Claims; Daniel A. Lewis, Judge.

Thomas E. Ashe, Miami, and Joseph T. Bambrick, Jr., West Reading, Pennsylvania, for West Contract Services.

Robert B. Scharf of Robert B. Scharf, P.A., Ft. Lauderdale and Diane H. Tutt of Diane H. Tutt, P.A., Plantation, for Jeffrey Rohr.

Richard B. Austin, Miami, for Georgia Wright Company.

West Contract Services and Georgia Wright Company appeal a worker's compensation order establishing that they were joint employers of the claimant at the time of injury. There is competent substantial evidence to support this finding, and we conclude that the judge was thus entitled to apply the doctrine of joint employment. The challenged order is therefore affirmed.

ALLEN and DAVIS, JJ., and SMITH, Senior Judge, concur.
