Before the Court is appellant's May 23, 2023 motion for a ninety-day extension of time to file appellant's brief. Appellant seeks an extension of time to September 21, 2023. The record has not yet been filed in this case, and appellant's brief is due thirty days after the record is filed. Tex.R.App.P. 38.6(a). Appellant's motion states the ninety-day extension is necessary because "Counsel needs additional time to adequately review the record and file Appellant's brief once the record is filed by the Court Reporter due on May 24, 2023." A motion for extension must provide "the facts relied on to reasonably explain the need for an extension." Tex.R.App.P. 10.5(b)(1)(C). Appellant's motion fails to meet this requirement. We DENY the motion for extension.
