Weeks Motor Corporation v. Lester

Appellate Division of the Supreme Court of New York, Fourth Department
Nov 18, 1942
265 App. Div. 909 (N.Y. App. Div. 1942)

Opinion

November 18, 1942.

Present — Cunningham, Taylor, Dowling, Harris and McCurn, JJ.

Order reversed on the law and facts, motion to set aside verdict denied and verdict reinstated with costs, on the ground that the evidence presented a fair question of fact for the jury as to the plaintiff's contributory negligence. All concur, except Harris, J., who dissents and votes for affirmance. (The order sets aside the verdict of a jury in favor of defendant for no cause of action, and grants a new trial in an automobile negligence action.)
