Opinion

No. 04-13-00480-CR

01-08-2014

William Charles WEBB, Appellant v. THE STATE OF TEXAS, Appellee

From the 54th District Court, McLennan County, Texas

Trial Court No. 2012-675-C2

Matt Johnson, Judge Presiding

ORDER

Appellant's brief was originally due October 25, 2013; however, the court granted appellant an extension of time to file the brief until December 30, 2013, sixty-six days after it was originally due. The court advised appellant that no further extensions would be granted absent a showing of extraordinary circumstances. On January 2, 2014, appellant filed a motion requesting a further extension of time.

We find that counsel has shown circumstances justifying a further extension, and we grant the motion in part. We order Patrick O. Brady to e-file the appellant's brief in this case by January 23, 2014 (ninety days after the original due date). Counsel is advised that no further extensions of time will be granted. If the brief is not filed by the date ordered, the court may abate this appeal and remand the case to the trial court for a hearing to determine whether appellant or counsel has abandoned the appeal.

Beginning January 1, 2014, attorneys in criminal cases are required to file all documents (except a document submitted under seal or subject to a motion to seal) in this court through the eFileTexas.gov electronic filing system. See TEX. R. APP. P. 9.2(c) (as amended effective January 1, 2014).
