JENNIFER WEBB, Appellant v. BENJAMIN SHAPLEY, Appellee

On Appeal from the County Court at Law No. 1 Galveston County, Texas
Trial Court Case No. 13-FD-1037

MEMORANDUM OPINION

Appellant, Jennifer Webb, representing that she and appellee, Benjamin Shapley, "have settled all their disputes," has filed a "Notice of Non-Suit," in which she moves to dismiss her appeal. See TEX. R. APP. P. 42.1(a)(1). No other party has filed a notice of appeal, and no opinion has issued. See id. 42.1(a), (c). And, although the motion does not include a certificate of conference, more than ten days have passed and no other party has responded. See id. 10.1(a)(5), 10.3(a).

Accordingly, we reinstate the appeal, grant appellant's motion, and dismiss the appeal. See id. 42.1(a), 43.2(f). We dismiss any other pending motions as moot.

PER CURIAM Panel consists of Justices Jennings, Higley, and Massengale.
