ERROR to the Court of Appeals of Warren county.

This cause came on to be heard upon the transcript of the record of the Court of Appeals of Warren county, as upon motion to dismiss the petition in error, by order of the Chief Justice. On consideration whereof, it is ordered and adjudged that said petition in error be, and the same hereby is, dismissed on authority of Miner v. Witt, 82 Ohio St. 237.

Dismissed.
