MEMORANDUM OPINION
The Court has before it the parties' October 29, 2009 agreed motion to dismiss the appeal and cross-appeal. The parties state they have reached an agreement to resolve their disputes. We grant the motion. See Tex. R. App. P. 42.1(a). We dismiss the appeal and the cross-appeal.
