Washington v. State

District Court of Appeal of Florida, Fifth District
Mar 23, 1989
539 So. 2d 1191 (Fla. Dist. Ct. App. 1989)

Opinion

No. 88-951.

March 23, 1989.

Appeal from the Circuit Court for Volusia County; John W. Watson, III, Judge.

James B. Gibson, Public Defender, and James R. Wulchak, Asst. Public Defender, Daytona Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Kellie A. Nielan, Asst. Atty. Gen., Daytona Beach, for appellee.

This is an appeal from a sentence. It is alleged and conceded that the court erred in using two separate guideline scoresheets as guides in sentencing. One should have been used for all crimes for which he faced sentencing at that time. Fla.R.Crim. P. 3.701(d)(1). It is also alleged that the trial judge improperly departed from the recommended guidelines sentence. If upon resentencing the court intends to depart it is proper to provide a written departure order.

SENTENCE QUASHED; REMANDED.

COWART and GOSHORN, JJ., concur.
