MEMORANDUM OPINION


Stephen Anthony Warren filed his notice of appeal from the trial court's order declaring him a vexatious litigant on January 5, 2007. We received notification from the trial court that the contest to appellant's affidavit of indigence was sustained. By letter dated October 24, 2007, we notified appellant that he was required to pay the $125 filing fee within ten days or the appeal would be dismissed. To date, appellant has neither paid the filing fee nor otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal. See Tex. R. App. P. 5, 42.3(c).
