Opinion filed April 14, 1941. Rehearing denied April 28, 1941.

MEDICINE AND SURGERY, § 20liability for doctor's fees. In doctor's action for fees defendants, husband and wife, were properly found liable for services plaintiff had rendered to wife's mother, where the mother was living with defendants and both requested plaintiff to render such services, but recovery was limited to amount stated in a bill plaintiff had sent to defendants after the death of the mother, although plaintiff testified he had never seen the bill, which was on his stationery, and did not know who had prepared it.

Appeal from Municipal Court of Chicago; Hon. JUSTIN MCCARTHY, presiding.

Reversed with finding of fact and judgment in this court in favor of Dr. Homer W. Warren and against C. J. Supernand and Hazel Supernand for $284. Heard in first division, first district, this court at December term, 1940.
