Ward v. State

District Court of Appeal of Florida, First District
Dec 15, 1982
423 So. 2d 561 (Fla. Dist. Ct. App. 1982)

Opinion

No. AO-113.

December 15, 1982.

An appeal from Circuit Court, Escambia County; William H. Anderson, Judge.

Tommy Jay Ward, pro se.

No appearance for appellee.

Ward appeals the trial court's oral denial, after an evidentiary hearing, of his motion for post-conviction relief, Rule 3.850, Florida Rules of Criminal Procedure. Because there was no written order filed denying said motion, we remand this cause to the trial court with instructions to enter a written order consistent with the requirements of Rule 3.850, Florida Rules of Criminal Procedure.

REVERSED AND REMANDED.

SHAW and JOANOS, JJ., concur.
