Dear Judge Kaplan:

This letter is in follow up to the Court's referal of the above-referenced matter to mediation. The parties previously jointly requested that this matter be sent for early mediation prior to engaging in extensive discovery on this matter. Thereafter, at the Court's direction, the parties jointly participated in a mediation in this matter and have continued to engage in discussions to resolve this case.

Both parties are currently located in Germany, which has delayed some of our discussions in this matter. However the parties jointly request that the Court permit the parties to continue these discussions for a brief additional period prior to resubmitting a proposed discovery schedule to the Court. Both parties believe that by avoiding the expenditure of costs, expenses and fees in discovery at this stage, it may facilitate the resolution of this matter.

The parties therefore respectfully request an additional period of time until March 14, 2005 to continue our settlement efforts. We will report back to the Court no later than that date on these efforts.
