Order affirmed, with ten dollars costs and disbursements. All concur, except Sears, P.J., and Crosby, J., who dissent and vote for reversal on the principles stated in the opinion in Caskie v. International Railway Company ( No. 2) ( 230 App. Div. 591), decided by this court November 12, 1930.
