ORDER GRANTING EX PARTE APPLICATION REMANDING CASE


The Court has reviewed Petitioners Joe Wallace, H.E. Christian Peeples and Dolores Jaquez's Ex Parte Application for an order remanding this action; Real Party in Interest's Notice of Removal and the Verified Petition for Writ of Mandamus and Complaint for Injunctive and Declaratory Relief ("Petition and Complaint"). Subject-matter jurisdiction lacking, the Court remands the case back to the Alameda County Superior Court from which it was removed so that the ongoing trial and hearing of the claims may continue on September 7 at 9:00 a.m.

GOOD CAUSE APPEARING, the Court hereby ORDERS the action remanded to the Alameda County Superior Court and DIRECTS that Judgment be entered.

IT IS SO ORDERED.
