Opinion

ALAN LYNDELL WADE Petitioner(s) v. STATE OF FLORIDA Respondent(s)

NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION AND, IF FILED, DETERMINED.

Lower Tribunal No(s).: 162005CF010263BXXXMA

Petitioner asks this Court to issue a writ of prohibition to prevent the circuit judge from continuing to preside over any further proceedings in his case. Below, Petitioner filed a motion to disqualify the circuit judge, which the circuit court denied. Because we conclude that the motion to disqualify was legally insufficient, we deny the petition.

CANADY, C.J., and POLSTON, LABARGA, LAWSON, MUÑIZ, COURIEL, and GROSSHANS, JJ., concur.

HON. MICHAEL R. WEATHERBY, JUDGE
