Appeal from Superior Court, City and County of San Francisco; John J. Van Nostrand, Judge.

Action by Arthur William Bourn Vincent against Charles J. McColgan, as Bank and Corporation Franchise Tax Commissioner, for a refund of personal income tax. Judgment for plaintiff, and defendant appeals.

Reversed.
