This case was called from the calendar at the Court's remote Houston, Texas trial session on November 1, 2021; and later for trial on November 3, 2021.

On January 18, 2022, respondent filed with the Court a Simultaneous Opening Brief (docket index entry No. 29), and, also filed a duplicate Simultaneous Opening Brief (docket index entry No. 30). Therefore, the Court will strike the duplicative filing.

After due consideration, and for cause, it is
