MECHANICS' LIENS, § 13delivery of materials, when ineffective. Where it appeared that at the time hardware was delivered by the plaintiffs to the property of the defendant they had actual knowledge that the hardware would not be used by the defendant in the erection of a building, plaintiffs were not entitled to a mechanics' lien.

Appeal from Circuit Court of Winnebago county; Hon. THOMAS E. GILL, presiding.

Affirmed. Heard in this court at October term, 1941.
