Opinion

Motion for leave to appeal to the Court of Appeals granted. This court certifies that questions of law have arisen which in its opinion ought to be reviewed by the Court of Appeals. The following question is certified: Was the order of this court, dated March 21, 1960, insofar as it affirmed the interlocutory judgment, properly made? The findings of fact made by the Special Term have been affirmed by this court. Beldock, Acting P.J., Kleinfeld, Christ, Pette and Brennan, JJ., concur.
