Verheyleweghen v. Harwood Contracting Company

Appellate Division of the Supreme Court of New York, Second Department
Mar 8, 1971
36 A.D.2d 732 (N.Y. App. Div. 1971)

Opinion

March 8, 1971

In a negligence action to recover damages for property injury, defendants appeal from a judgment of the Supreme Court, Richmond County, entered February 11, 1970, in favor of plaintiffs upon a jury verdict. Judgment reversed, on the law and the facts, and new trial granted in the interests of justice, with costs to abide the event. In our opinion, the proof adduced by plaintiffs was insufficient to establish that the pontoon which damaged their dock was cast adrift by negligence of defendants. Rabin, P.J., Latham, Christ, Brennan and Benjamin, JJ., concur.
